Challenge:

Our client purchased an existing franchise territory. However, the business’s performance and financial reports were insufficient to support a strong E-2 Chance of Status application. The business lacked sufficient revenue, net profit, meaningful job creation, and the income needed to provide our client with a salary for a comfortable living with his family in the U.S.

Strategy:

We offered our client the strategy of expanding the business by acquiring additional territories for the existing franchise. Our client was able to negotiate a deal with the franchise purchased additional new territories to the existing franchise agreement.

We then recommended our client to begin operations immediately after the business purchase was finalized and the business was ready with employees. The goal was to demonstrate a positive performance trajectory through financial reports from the first two months under the client’s ownership, showcasing the potential of the business.

Our client hired a transition manager from day one to oversee the operations on her behalf. This was not only to ensure smooth management of the business during the transition period but also, and most importantly, to demonstrate that she was not actively working in the business without the proper employment authorization.

Although it was a challenging process, especially since our client was navigating the change of status from within the United States, she followed our recommendations and stayed committed to the process despite the limited time available.

Results:

Our client's E-2 COS application was approved. The combination of strong financial performance for the first two months and the strategy of acquiring additional territories significantly strengthened the application.

This case demonstrates that even an existing business with underwhelming performance can be transformed into a successful venture with the right strategies. By taking a proactive approach and expanding the business our client overcame obstacles and successfully obtained E-2 status in the U.S.
